Last Will and Testament of Mary Burt

I, Mary Burt of Fremont County and State of Iowa, being of lawful age and sound mind, do make and publish this my last will and Testament, as follows, that is to say:

1st. I direct that my remains be decently interred and that my funeral expenses and just debts be paid out of the first money coming into the hand of my Executor, from any part of my estate.

2nd. I give and bequeath unto my beloved daughter, Jane Burt, my side saddle and bureau, one bed and bedclothes sufficient for it, and one red heifer.

3rd. I give and bequeath unto my beloved son, Andrew Burt, one bed and the bedclothes belonging to it and to my beloved son Matthew Burt one bed and bedclothes belonging to it.

4th. I give and bequeath to my two sons, the said Andrew and Matthew all the balance of my personal property remaining after the payment of all my debts and not otherwise disposed of in this will to have the same in equal shares.

5th. I give and bequeath to my two said sons, Andrew and Matthew the following described tract of land in said county and state, being all of the land of which I am now seized, to wit: the south half of the northeast fourth of section #14, township #69 N of range 42 W, with all the privileges and appurtenances to the same belonging, to have and hold the same to the said Andrew Burt and Matthew Burt and their heirs, assigns forever and that I direct and will that my two said sons, Andrew and Matthew, who are miners (sic) have the immediate possession and use of said land to do the same as they think proper, provided they shall not have the power to sell or transfer said land until they are over the age of twenty-one years.

6th. I make and appoint my beloved son Silas Burt executor of this my last will and testament.

Signed, sealed, published and declared by the above named Mary Burt as to her last will and testament in the presence of us who have hereunto subscribed our names as witnesses thereto in the presence of the said testator and in the presence of each other.
