In the District Court of Davis County, Iowa. In vacation.

In the matter of the assignment of Ellis Downing. Insolvent} Assignee's report of sale of 60 acres of land in sec. 32,70,12,etc.

To said court:- The undersigned, assignee of Ellis Downing, respectfully reports:- 1st. That under the deed of assignment made to him by said Ellis Downing, in the above entitled proceeding, the title to the following described real estate, to-wit:- The NE ¼ of the SE ¼ & North- half of the NW ¼ of the NW ¼ of section 32, in township 70 North, of range 12 west in Davis County, Iowa passed to him, as such assignee. 2nd. That he has sold the said 60 acres of land above described, at private sale, to Joseph Thompson at 17 dollars and 50 cents per acre, subject to the approval of said court or of a judge thereof, same to be paid on or before March 10th, 1899. 3rd. I will add that said Thompson purchased 140 acres of land of the referees in the case Alva Downing et.al.vs. Addie M Downing et.al.pending in said court, at the price per acre as he sold the aforesaid 60 acres, as above recited; that I regard $17.50 per acre for said 60 acres as the full cash market value thereof and regard that the interest of the creditors of the said Ellis Downing will be promoted by said sale and I respectfully recommend that said sale of said 60 acres be approved and that I be authorize to convey the said tract to said Thompson on the payment of the purchase price above named. Apr. 25, 1899   Ellis Downing, former resident commits suicide Tuesday at his home in Davis County, Age 65.

 

Ellis Downing was born in Fountain County, Indiana in the early part of the year 1835. He with his mother and only brother, Moses downing, came to Davis County, Iowa, in the fall of 1848. The mother of these 2 boys entered 240 acres of land in Sec 32, 70-12 in Salt Creek township, Davis County, Iowa, which land the boys owned up to the death of their mother which occurred in May, 1891.

Ellis Downing was of a restless disposition, very honest, industrious, always at work, accumulated considerable property, and he was thought by his most intimate friends to be getting along well financially. Something over a year ago however he thought it best to make an assignment of his property, both personal and real, for the benefit of his creditors, which he did. After the real and personal property had been sold and applied on his indebtness, and the debts not all cancelled, it seemed to worry him. He brooded over it, looked at the dark side of everything, and was living alone. the funeral took place at the residence of his oldest son, David Downing, of Chequest, April the 20th, at 1 o'clock pm. Short but appropriate religious services were conducted by J H Downing of Chequest, after which the remains were followed by a large concourse of sympathizing friends and neighbors to the Rouch grave yard, where the body was carefully and tenderly laid away by the side of his mother to sleep the sleep that knows no waking, till Jesus comes.
